MEMORANDUM AND ORDER: Defendant's 20 motion to dismiss is granted, and the complaint is dismissed with prejudice. Further leave to amend will not be granted. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore IFP status is denied for purposes of an appeal. C/M. Forwarded for judgment.
