MEMORANDUM AND ORDER, The Court grants pltff's request to proceed in forma pauperis pursuant to 28 USC sec. 1915(a) solely for the purpose of this order. Accordingly, the complaint, filed in forma pauperis, is dismissed for lack of subject matte r jurisdiction pursuant to FRCP 12(h)(3). To the extent pltff raises any state law claims, the state law claims are dismissed without prejudice. The Court certifies pursuant to 28 USC sec. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
