MEMORANDUM AND ORDER, For the reasons stated herein, the Petitioner's request to proceed in forma pauperis is granted pursuant to 28 USC sec. 1915, and the Petition is dismissed. The Court is without jurisdiction to entertain the Petition. The C ourt certifies pursuant to 28 USc sec. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
