TRANSFER ORDER: Pursuant to the venue provision governing federal question jurisdiction, this action must be filed in the judicial district where defendants reside or where a substantial part of the events or omissions giving rise to the claim occurr ed. Here, defendants Pineiro and Donofrio are employed by the New York Police Department at the 50th Police Precinct which is located in Bronx County, and plaintiff does not allege that any of the events alleged occurred within the Eastern District o f New York. Accordingly, this case is hereby transferred to the United States District Court for the Southern District of New York. A ruling on plaintiff's application to proceed in forma pauperis and enforcement of the Prison Litigation Reform Act is reserved for the transferee Court. That provision of Rule 83.1 of the Local Rules of the Eastern District of New York which requires a five-day delay is waived. A summons shall not issue from this Court. SO ORDERED.
