MEMORANDUM AND ORDER: Petitioner's request to proceed in forma pauperis pursuant to 28 U.S.C. § 1915 is granted. The petition for a writ of habeas corpus is dismissed without prejudice as premature. Petitioner is reminded that he may not file a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 until he has exhausted his state court remedies. A certificate of appealability will not issue because petitioner has not made a substantial showing of the denial of a constitutional right.
