MEMORANDUM DECISION AND ORDER, For the reasons set forth herein, the petition is dismissed. Petitioner has failed to make a substantial showing of the denial of a constitutional right. A Certificate of Appealability shall not issue re 1 Petition fo r Writ of Habeas Corpus. Further, this Court certifies pursuant to 28 USC sec. 1915(a)(3), that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
