MEMORANDUM AND ORDER ADOPTING REPORT AND RECOMMENDATIONS: For the reasons stated above, the Court adopts Magistrate Judge Bloom's recommendation that Patel's habeas petition be denied. Since Patel has not made a substantial showing of the denial of a constitutional right, a certificate of appealability shall not issue. 28 U.S.C. § 2253(c).
