MEMORANDUM AND ORDER, For the reasons set forth herein, Deft's 15 Motion to Dismiss is denied without prejudice to requesting permission, at the close of discovery, to move for summary judgment pursuant to 5 USC sec. 701(a)(2) and with respec t to Pltff's compensatory damages claims. If Pltff wishes to amend his pleading to specifically allege a legal basis for awarding compensatory damages, he must request a pre-motion conference on or before 10/19/12, in accordance with Section III .A. of this Court's Individual Motion Practices and Rules. Defts' time to answer the complaint is extended to 10/26/12, and will be further extended if Pltff files a pre-motion conference request. (Ordered by Judge Sandra L.
