MEMORANDUM & ORDER granting 13 Motion to Dismiss for Failure to State a Claim. The motion is GRANTED. Given the nature of the factual gaps in the Complaint, Plaintiff may be able to cure some or all of the issues identified in the accompanying Me morandum and Order. Accordingly, the court grants Plaintiff leave to file an amended complaint within fourteen (14) days of the date of entry of the accompanying Memorandum and Order. If Plaintiff opts not to amend, the court will enter judgment in favor of Marshalls and close the case. Ordered by Judge Nicholas G. Garaufis on 12/29/2015. (Ezray, Evan)
