MEMORANDUM AND ORDER: For the reasons set forth, Maldanado is given thirty (30) days leave to file an amended complaint. See Cruz v. Gomez, 202 F.3d 593 (2d Cir. 2000). The amended complaint must be captioned as an "Amended Complaint," an d bear the docket number 16-CV-4191 (CBA) (LP). No summonses shall issue at this time and all further proceedings shall be stayed for thirty(30) days. If Maldanado fails to amend the complaint within the time allowed, this case will be dismissed. T he Court certifies pursuant to 28 U.S.C. §l9l5(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444--45 (1962). Ordered by Judge Carol Bagley Amon on 12/28/2016. (Fernandez, Erica)
