MEMORANDUM AND ORDER: For the foregoing reasons, the Court concludes that dismissal under Fed. R. Civ. P. 41(b) is not appropriate and grants Pltff's motion to serve his complaint under Fed. R. Civ. P. 4(m) nunc pro tunc. Pltff shall serve and file his complaint by 5/28/10, and Dfts shall respond to the complaint by 6/17/10. The case is hereby referred to the assigned Magistrate Judge for pretrial purposes. Ordered by Judge Roslynn R. Mauskopf on 5/17/2010. (Abdallah, Fida)
