OPINION AND ORDER granting in part and denying in part 45 Motion for Summary Judgment. For the reasons stated herein, the branches of Spa 77's motion seeking summary judgment on its final and third causes of action are granted to the extent t hat Spa 77 is awarded two hundred twenty thousand dollars ($220,000.00), plus attorney's fees and legal expenses as set forth herein, and Spa 77's motion is otherwise denied. The parties are directed to appear with authority or with p ersons with authority to settle this matter in my courtroom located at 1010 Federal Plaza, Central Islip, New York, 11722, on March 7, 2011 at 12:30 p.m. for a pretrial conference.
