MEMORANDUM AND ORDER - Petitioner's 4 motion for leave to proceed in forma pauperis is granted, and his 1 Motion for Writ of Mandamus is denied and the Petition is dismissed without prejudice. In the event that Pltff chooses to file an Amended Petition, he must do so by 9/25/09.
