MEMORANDUM & ORDER granting 55 Motion to Dismiss for Failure to State a Claim; dismissing 62 Motion for Summary Judgment; dismissing 66 Motion for Summary Judgment. For the reasons discussed in the attached Memorandum & Order, the Court gra nts the United States' motion to dismiss Plaintiffs' FTCA claim for lack of subject matter jurisdiction. The Court declines to exercise supplemental jurisdiction over Plaintiffs' state law claims against Defendants Andifred and Precise and dismisses Plaintiffs' claims against Andifred and Precise without prejudice.
