ORDER: SO ORDERED that the Commissioner's motion for judgment on the pleadingspursuant to Rule 12(c) of the Federal Rules of Civil Procedure is granted, and Plaintiff's cross-motion for judgment on the pleadings pursuant to Rule 12(c) of th e Federal Rules of Civil Procedure is denied.
