A hearing on defendant Trans World Entertainment Corporation's Motion to Partially Dismiss the Complaint is currently scheduled for July 22, 2005. Both parties have conflicts on that date and have agreed to reschedule the hearing for your next motion hearing date in Albany on August 26, 2005, at 10:00 a.m. There have been no prior requests for an extension and the proposed adjournment will not result in any delays in this case as the Case Management Conference is not scheduled to take place until August 23, 2005. The parties also have agreed to the following modifications to the briefing schedule: Response to the Motion due by July 15, 2005 and Reply to Response to Motion due by August 1, 2005. The parties respectfully request that you enter an order rescheduling the Motion Hearing for August 26, 2005 at 10:00 a.m. and modifying the briefing schedule as set forth above.
