Dear Judge Homer: As you will recall, the above-referenced matter was settled by stipulation on the record and the Court entered an Order on October 24, 2006 dismissing the case subject to reopening upon a showing that the settlement was not consummated. One term of the settlement is that releases be exchanged between the parties. As of this date, we have not yet received a release signed by an officer of Transworld Entertainment Corporation. The deadline to move to reopen the case is November 24, 2006. We hereby request that said deadline be extended two weeks until December 8, 2006, with the hope that defendant will provide a proper release. Thank you for your consideration.
