REPORT AND RECOMMENDATION: It is RECOMMENDED that Plaintiff's motion for judgment on the pleadings be granted, the Commissioner's motion be denied, the decision of the Commissioner be reversed, and the case be remanded pursuant to sentence 4 of 42 U.S.C. § 405 (g) for further administrative proceedings. It is ORDERED that Objections to this R&R are due by 12/13/2010. Failure to timely file objections or to request an extension of such time waives the right to appeal any subsequent Order by the District Court adopting the recommendations contained herein.
