On June 8, 2012 Mediator George H. Lowe conferred by telephone with
attorneys for all parties. Counsel reported that progress towards a resolution of the
action continued. On August 1, 2012, counsel reported that it was anticipated that all of
the underlying criminal proceedings (see Docket No. 1, at ¶ 4) would be dismissed
shortly. If so, this should pave the way for final resolution of the pending action.
Counsel are directed to file a further status report on or before August 24, 2012.
