McCurn Senior Judge, U.S. District Court Northern District of New York Syracuse, New York 13261 Re: Yoder, et al. v. Town of Morristown, et al. Civil Case No.: 09-cv-0007 (NPM/GHL) Dear Judge McCurn: We write to respectfully request that the Court consider the attached document in support of Defendants' motion currently pending before the Court (Dkt. No. 42). As can be seen from this document received from the State of New York, our client, as well as many other municipalities, has just received a directive from the State specifically addressing the issue of enforcement of the building code with respect to the Amish. We believe that this document is relevant and pertinent to the motion before the Court as it makes clear the State of New York's position with respect to enforcement of the NYS Building Code as it pertains to the Amish as well as other individuals. Thank you for the Court's consideration. Respectfully submitted, LEMIRE JOHNSON, LLC Jacinda H. Conboy Jacinda H.
