DECISION and ORDER
Plaintiff brought this civil rights action pursuant to 42 U.S.C. ยง 1983. On August 2,
2011, the Honorable Randolph F. Treece, United States Magistrate Judge, advised, by
Report-Recommendation, that defendant's motion to dismiss pursuant to Federal Rule of
Civil Procedure 12(b)(6) be granted and the case be dismissed. No objections to the ReportRecommendation were filed.
Based upon a careful review of the entire file and the recommendations of the
Magistrate Judge, the Report-Recommendation is accepted in whole. See 28 U.S.C.
636(b)(1).
Therefore, it is
ORDERED that
1. Defendant's motion to dismiss pursuant to Federal Rule of Civil Procedure
12(b)(6) is GRANTED; and
2. The complaint is DISMISSED in its entirety.
The Clerk is directed to enter judgment accordingly and close the file.
