ORDER: for 41 Report and Recommendations re: 47 Motion for Summary Judgment filed by NYC Dept. of Citywide Administration Services. Accordingly, the Court hereby adopts the Report, and, for the reasons stated therein, denies plaintiff's moti on for summary judgment. As also recommended by Judge Ellis, the Court further directs the parties to file their Joint Pretrial Order 30 days from the date of this Order - i.e., no later than October 1, 2009.
