MEMORANDUM ORDER: Accordingly, NAKTA's application to dismiss the case for lack of subject matter jurisdiction is DENIED, as are its applications for reconsideration. This matter is referred to Magistrate Judge Dolinger for further proceedings including inquest and a report and recommendation in connection with any application for judgment by default on EGI's counterclaims.
