MEMORANDUM OPINION AND ORDER:#97810 For the reasons set forth herein, The Court adopts Magistrate Judge Gorenstein's report and denies Mudd's petition. As petitioner has not made a substantial showing of a denial of a federal right, Tankle ff v. Senkowski, 135 F.3d 235, 241 (2d Cir. 1998), the Court declines to issue a certificate of appealability. See 28 U.S.C. 2253(c)(2)(1996). However, petitioner may pursue any further appellate remedies in forma pauperis. The Clerk of the Court is directed to dismiss the petition and close this case.
