OPINION:#98694 For the foregoing reasons, plaintiffs' motion for summary judgment is denied. Defendant's motion for summary judgment is denied. Defendant's motion for summary judgment is granted, but only in regard to the NYGBL 349 claim. All other issues remain for the jury.
