Banks v. Horn et al
Filing 43
ORDER ADOPTING REPORT AND RECOMMENDATION: After conducting a thorough review of the Report, the Court concludes that Plaintiff did indeed fail to exhaust his administrative remedies and, in any event, has failed to produce sufficient evidence to supp ort his claim of constitutionally deficient medical care. Therefore, Plaintiffs objections to the Report are rejected and the Report is adopted in its entirety. Accordingly, Defendants' motion for summary judgment is GRANTED. The Clerk of the Court is respectfully directed to terminate the motion located at docket number 29, enter judgment on behalf of Defendants, and close the case. (Signed by Judge Richard J. Sullivan on 7/6/2010) (jpo)
