OPINION AND ORDER:#98005 Defendant's motion for summary judgment is DENIED. Defendant's motion to strike is also DENIED. This matter will go forward to trial on all of Primmer's claims as scheduled in November 2009. A trial notificat ion setting forth a date certain for trial and the deadlines for submission of pretrial materials will be transmitted to the parties in due course.
