MEMORANDUM & ORDER: Plaintiff's motion is DENIED. The portions of Defendants' motion for summary judgment on the issues of probably cause, qualified immunity, and malicious prosecution are DENIED. The Defendants' motion to dismiss th e Section 1983 claims against the City is GRANTED. The Defendants' motion to dismiss all claims against the Police Department is GRANTED.
