Notice is hereby given that Irving H. Picard (the “Trustee”), as trustee for the liquidation
of the business of Bernard L. Madoff Investment Securities LLC under the Securities Investor
Protection Act, 15 U.S.C. §§ 78aaa, et seq., and the substantively consolidated estate of Bernard
L. Madoff, movant-intervenor in the above-named case, hereby appeals to the United States
Court of Appeals for the Second Circuit from the order of March 8, 2013 (Dkt. No. 1071),
denying the Trustee’s motion to intervene; the order of March 15, 2013 (Dkt. No. 1091), denying
the Trustee’s request to supplement the record with his proposed intervention papers and
directing the clerk to strike those papers as erroneously entered; and the Final Judgment and
Order of Dismissal with Prejudice of March 25, 2013 (Dkt. No. 1097), approving the Settlement.
