Fairfield Greenwich Limited, et al., 09-CV-00118 Dear Judge Marrero: We write on behalf of the Anwar Plaintiffs in the above-referenced action. As previously reported, the mediation proceedings held at the direction of the Court have not resulted in settlement of Plaintiffs' claims against either the Citco Defendants or the PwC Defendants. We also now know that Plaintiffs' settlement with the Fairfield Greenwich Defendants has become final, so that they no longer have any potential involvement as parties. The Court advised the parties during a conference call this past July that this case, filed in January 2009, is one of the oldest matters on the Court's docket. In light of the foregoing, the Anwar Plaintiffs respectfully request that the Court set a trial date at this time. Although there are issues that remain outstanding, we believe that setting a trial date now will allow the parties and their counsel to arrange their schedules accordingly, and will minimize the prospect of further delays that would likely occur if we were to await the resolution of all such issues before setting the trial schedule. Plaintiffs believe that a trial in the latter part of 2015 is feasible and would allow for determination of the pending class certification motion, as well as resolution of summary judgment motions which would follow thereafter. While rulings on these motions could, of course, impact the amonnt of time needed for trial, Plaintiffs believe the case, in its current posture as a class action against both Citco and PwC Defendants, should be triable in three to four weeks.
