Bank International (Americas) Limited, No. 11-cv-7651 (S.D.N.Y.) (“Quiroz Stone”) hereby
stipulate and agree that, pursuant to Federal Rule of Civil Procedure Rule 41(a)(1)(A)(ii), the
Lyac Venture Corp. and Quiroz Stone actions are DISMISSED with prejudice and without an
award of costs or fees to any party.
