MORNING MIST PLAINTIFFS' NOTICE OF MOTION TO VACATE CONSOLIDATION ORDER AND TO APPOINT MOVANTS' COUNSEL AS CO-LEAD DERIVATIVE COUNSEL PLEASE TAKE NOTICE that Morning Mist Holdings Limited and Miguel Lomeli, plaintiffs in No. 09 CV 5012 (VM) (the "Action"), by their undersigned counsel, upon the accompanying declaration of Kent A. Bronson, dated June 23, 2009, the accompanying memorandum of law, and all prior papers had herein, hereby move the Court for an Order: (i) vacating the Court's Order dated June 9, 2009 (Dkt. No. 167, 09 CV 0118 and Dkt. No. 11, 09 CV 5012), which consolidated for pretrial purposes the Action with Anwar v. Fairfield Greenwich Group, 09 CV 0118 (VM); (ii) appointing movants' counsel, Milberg LLP and Seeger Weiss LLP, as Co-Lead Derivative Counsel; and (iii) awarding such other and further relief as the Court may deem just and proper.
