ORDER: The Court has considered the parties' letter-submissions dated October 8, 9, 13, 14, 21, and 22, 2009, regarding the applicability of the Private Securities Litigation Reform Act discovery stay to this action, and concludes as further set forth in this Order. Accordingly, it is hereby ORDERED that (i) Plaintiffs' request to lift the PSLRA discovery stay is denied; and (ii) the Court defers any decision on Derivative Plaintiffs' request to lift the stay until after disposition of the remand motions.
