ORDER that the Clerk of Court is directed to consolidate the two cases captioned herein (09cv118 and 09cv9423) for all pretrial purposes. All filings in connection with the consolidated action shall be docketed against the remaining lower number case 09cv118 and the Clerk of Court shall close the referenced higher numbered case, 09cv9423, as a separate action and remove it and any pending motions from the Court's database.
