ENDORSED LETTER addressed to Judge Victor Marrero from Richard E. Brodsky dated 10/19/10 re: counsel for plaintiffs in Maridom Ltd. v. Standard Chartered Bank International (Americas) Ltd. writes that in its Decision and Order (Order") dated October 4, 2010, DE 543, this Court denied the Defendant's motion to dismiss in all respects except as to what the Court characterized in its Order as an allegation that the Defendant affirmatively misrepresented that Fairfield would manage the investments when, in fact, Madoff did. (Order, p. 23) While the Maridom Plaintiffs respectfully submit that this allegation was, in fact, an allegation that the Defendant failed to disclose that Fairfield falsely represented that it would be managing the investments, Am. Cplt., paragraph 23, the Maridom Plaintiffs are not seeking an amendment or clarification of that point and therefore will not be filing a paper showing why an amendment attempting to cure the pleading deficiency would not be futile. ENDORSEMENT: The Clerk of Court is directed to enter into the public record of this action the letter above submitted to the court by plaintiffs in the Maridom Ltd. action.
