ORDER: that the motion of plaintiff Pacific West Health Medical Center, Inc. Employees Retirement Trust for a preliminary injunction is DENIED. The Court's January 9, 2009 Order (Docket No.6) is hereby rescinded. The parties are directed to submit to the Court by January 29, 2009 a proposed joint Case Management Plan or to advise the Court in the event that they are unable to agree upon the provisions of such plan.
