Pierce and Frank E. Pierce IRA, plaintiffs in No. 09 CV 2588 (VM) (the "Action"), by their undersigned counsel, upon the accompanying declaration of Robert A. Wallner, Esq. and memorandum of law, and all prior papers had herein, hereby move the Court for an Order: (i) pursuant to 28 U.S.C. ง 1447(c), remanding the Action to the Supreme Court of the State of New York, County of New York, and awarding plaintiffs costs incurred as a result of the removal of the Action; (ii) striking the declaration of Michael Thorne, dated March 19, 2009 (Dkt. 1, Exhibit B, 09 CV 2588); (iii) vacating the Court's Order dated March 31, 2009 (Dkt. No. 5, 09 CV 2588), which consolidated the Action with Anwar v. Fairfield Greenwich Group, 09 CV 0118 (VM); and (iv) awarding such other and further relief as the Court may deem just and proper.
