ORDER ADOPTING REPORT AND RECOMMENDATIONS: Accordingly, the Court adopts the R&R in its entirety and GRANTS Hinton's motion to dismiss without prejudice. The Court also DENIES Monster's motion to dismiss as moot. Finally, the Court adopts M agistrate Judge Ellis's recommendation that if Hinton reinitiates this action, he must respond to Monster's motion to dismiss before further action is taken. The Clerk of the Court is directed to close this mailer. Pursuant to 28 U.S.C 1915(a), I find that any appeal from this order would not be taken in good faith. So Ordered (Signed by Judge Paul A.
