OPINION & ORDER #99714 re: 20 FIRST MOTION for Summary Judgment. For reasons futher set forth in said Order, Defendants' motion to dismiss on summary judgment is GRANTED as to the federal claims, and the remaining claims are DISMISSED without prejudice for lack of subject matter jurisdiction.
