OPINION AND ORDER, that for the reasons described in this Order, plaintiffs and counterclaim defendant's motion for summary judgment is DENIED. Defendant's motion for summary judgment is GRANTED to the extent that it seeks dismissal of Plai ntiff s claims for breach of contract, bad faith denial of coverage and Tort Action under Ohio law, and is otherwise DENIED.
