ORDER

On October 27, 2010, the Court entered a Consent Order and Judgment as to Defendant
Roomy Khan. At that time, counsel for the Commission and counsel for Khan asked that the

Court defer a detennination of civil penalties-so that any such detennination could pennit an
assessment of Khan's cooperation. Accordingly, the Consent Order provided that the Court
would detennine no later than October 27,2011, whether it is appropriate to order a civil penalty
against Khan and, ifso, the amount ofthe penalty, Counsel for the Commission and counsel for
Khan have jointly requested an adjournment ofthe control date set previously by the Court and
have supported that request with good cause. Accordingly,

IT IS HEREBY ORDERED, -ADJUDGED, AND DECREED that the date by which the
Court shall detennine whether it is appropriate to order a civil penalty against Khan and, if so,
the amount of the penalty, is hereby adjourned to December 31, 2011.

SOO/WO'd

IT IS FURTHER ORDERED that; otherwise, the Consent Order, and Judgment as to
Defendant Roomy Khan shall remain in full force and effect.
