STIPULATION AND ORDER

On May 17,2010, the Court entered a Consent Order and Judgment as to Defendant Anil
Kumar. At that time, counsel for the Commission and counsel for Kumar asked that the Court
defer a determination of civil penalties so that any such determination could permit an
assessment of Kumar's cooperation. Counsel for the Commission and counsel for Kumar have
jointly requested and stipulated to an adjoununent of the date set previously by the Court and
have supported that request with good cause. Further, both parties recognize that no further
adjournments shall be granted. Accordingly,
IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that the date by which the
Court shall determine whether it is appropriate to order a civil penalty against Kumar and, if so,
the amount of the penalty. is hereby adjourned to June 29, 2012.
