STIPULATION AND ORDER

On June 8, 2011, the Court entered a Consent Order Ilnd Judgment as to Defendant
Oautham Shankar, At that time, counsel for the Commission and counsel for Shankar asked that
the Court defer a detennination of civil penalties so that any such detennination could permit an
assessment of Shankar's cooperation. Counsel for the Commission and counsel for Shankar have
jointly requested and stipulated to an adjournment of the date set previously by the Court and
have supported that request with good cause. Further, both parties recognize that no further
adjournments shall be sranted. Accordingly,
IT IS HEREBY ORDERED, ADnJDGED. AND DECREED that the date by which the
Court shall detennine whether it is appropriate to order a civil penalty against Shankar and, ifso.
the amount of the penalty, is hereby adjourned to April 27, 2012.
