OPINION AND ORDER. Defendants' Motion for Summary Judgment is DENIED as there are disputed issues of material fact concerning whether Defendant was deliberately indifferent to Plaintiff's medical needs as well as whether Defendant retaliate d against the Plaintiff for filing a grievance. Plaintiff's Motion to Amend the Complaint to name Dr. Koenigsmann as a Defendant is GRANTED Re: 23 MOTION for Summary Judgment filed by Byron Rodas, Fedrick Bernstein, 34 MOTION for Leave to File Amended Complaint filed by Pedro Castillo.
