OPINION: For the foregoing reasons, the Court finds that Bayer has failed to establish a likelihood of source confusion or product confusion, and therefore has failed to establish trademark infringement in violation of 15 U.S.C. §1114(1), unfair competition in violation of 15 U.S.C. § 1125(a), or unfair competition under New York common law. The Court therefore directs the clerk to enter judgment in favor of Aceto and to close this case. (Signed by Judge Alison J. Nathan on 7/30/2012) (mro)
