AS AND FOR A FOURTH AFFIRMATIVE DEFENSE: 405. The NYPD defendants have not violated any rights, privileges or immunities secured to plaintiff under the Constitution or laws of the United States or the State of New York or any political subdivision thereof, nor have defendants violated any act of Congress providing for the protection of civil rights. - 45 - AS AND FOR A FIFTH AFFIRMATIVE DEFENSE: 406. The individual defendants are shielded from suit by the doctrines of absolute immunity, qualified immunity, common law immunity, judicial immunity, or any combination of these doctrines. AS AND FOR A SIXTH AFFIRMATIVE DEFENSE: 407. Any injury alleged to have been sustained resulted from plaintiff’s own culpable or negligent conduct and was not the proximate result of any act of the NYPD defendants. AS AND FOR A SEVENTH AFFIRMATIVE DEFENSE: 408. At all times relevant to the acts alleged in the amended complaint, the NYPD defendants acted reasonably, properly, lawfully and in good faith in the exercise of their discretion. Consequently, NYPD defendants are entitled to governmental immunity. AS AND FOR A EIGHTH AFFIRMATIVE DEFENSE: 409. Plaintiff has not satisfied all conditions precedent to suit. AS AND FOR A NINTH AFFIRMATIVE DEFENSE: 410.
