agree that any disclosure by the City or correc뛕�on to the JPTO is un뛕�mely, burdensome or prejudicial, and the
handful of documents recently provided do not fall within plain뛕�ff’s discovery requests.  They were provided
promptly a횦�er we determined that the materials would be used at trial.  Several of the items listed and
provided are publicly available on the internet, and were produced solely as an aid to iden뛕�fica뛕�on.  Only one
witness has been added since the dra횦� JPTO was exchanged, which hardly presents a burden, and all par뛕�es,
including the plain뛕�ff, reserved the right to modify the dra횦�s.  Moreover, addressing these ma�ers does not
impact the comple뛕�on of the JPTO.  Your objec뛕�on to the items or witness may be noted therein, and you
may move subsequently for whatever relief you see fit. 

In addi뛕�on, the plain뛕�ff has been dilatory in iden뛕�fying its own exhibits and some of the exhibits cannot be
iden뛕�fied from the informa뛕�on provided, as we and others have noted, and may never have been shared
with defendants, even now.  We will note objec뛕�ons on that basis in the JPTO.

Therefore, the City would oppose any request for addi뛕�onal 뛕�me as dilatory and a needless distrac뛕�on from
trial prepara뛕�on, and request to the Court that if the 뛕�me were to be granted, that all other dates, including
the trial date, be adjourned concomitantly.

Thank you for putting this together.  These, hopefully, are our final changes, subject to what we see in the next
day or so.

Attached are our objections in Judge Sweet’s format.  The ones that are not mentioned we have no objection.

Also, under our claims and defenses, please substitute this paragraph for the one currently in the PTO
(subdivision B, second paragraph):

Dr. Isakov claims that his decision to confirm the admission of Adrian Schoolcraft to Jamaica Hospital pursuant
to  Section  9.39  of  the  New  York  State  Mental  Hygiene  Law  was  consistent  with  the  standards  of  accepted
medical  practice.    Dr.  Isakov  also  claims  that  his  decision  to  confirm  the  admission  of  Adrian  Schoolcraft  to
Jamaica  Hospital  is  privileged  because  he  did  not  commit  medical  malpractice.    In  this  regard  defendant  Isak
Isakov,  M.D.  contends  that  all  of  his  care  and  treatment  of  the  patient,  and  all  decisions  made  with  respect  to
Adrian  Schoolcraft,  were  in  accordance  with  the  standards  of  practice  in  the  community  within  which  he
practices.
