WHEREAS, Plaintiffs The New York Times Company and Charles Savage filed
the Complaint commencing this action under Freedom of Information Act, 5 U.S.c.
§ 522 ("FOIA") on or about October 18, 2010, asserting two causes of action, the first
secking the release of certain statistical information about assessments done by
Defendant the Federal Bureau of Investigution to colle<.:t information i.\bout individuals or
organizations who may be involved in national security threats ("Collnt I") and one
secking the release of certain Shooting lncident Review Team Reports ("SIRT Reports")
and a related summary document ("Counl If");
WHEREAS, during the pendency of Ihis litigation Defendant produced to
Plaintiffs redacted versions of the SIRT Reports and the related summary document (the
"SIRT Production");
WHEREAS, Plaintiffs acknowledge that as a result ofthe SIRT Production,
Count n is moot;
THEREFORE, the parties agree and stipUlate as follows:
Count II of the Complaint shall be dismissed with prejudice pursuant to Fed. R.
Civ, P. 41(a).
