MEMORANDUM AND OPINION: For the foregoing reasons, Fidelity's motion to dismiss the complaint as to it [10 Civ.8631 Dkt. 36] is granted. As this ruling disposes of all claims asserted against Fidelity and it raises an issue peculiar to this defe ndant, there is no just reason for delay and the Clerk is directed to enter judgment of dismissal as to Fidelity.
