Whether the registration is for a "lacquered red sole" generally, or only the particular shade printed on Registration No, 3,361,597, a single primary color for an article of fashion is aesthetically functional and, as such, no fashion company should be permitted to monopolize that color. ENDORSEMENT: The Clerk of Court is directed to enter into the public record of this action the letter above submitted to the Court by defendant. So ordered.
